Terms of use

This is an English translation provided for convenience. If it differs from the Persian original, the Persian version applies.

This text is an agreement between you and TweakFa. By creating an account, purchasing a subscription or using the app, you accept these terms. If you object to any clause, raise it with support before purchasing.

1. Parties to the agreement

“TweakFa” means the business that provides the website tweakfa.com and the services listed below, with the contact address info@tweakfa.com:

• Phoenix Guardian, a Windows app for graphics card tuning, game recording, monitoring and power control.
• Phoenix Hub, a Telegram bot for building PC configurations and viewing price lists.
• PC buying and assembly consultation.
• Calculators, blog and educational content.

“You” means anyone who uses these services, whether or not they create an account.

2. Age and legal capacity

To purchase a subscription, you must be of legal age or make the purchase with the permission of your guardian. If a payment is made with another person’s card, you are responsible for it.

3. User account

You sign in to your account with your mobile number and an SMS code. A password is optional, and you can create one from your account at any time.

• The number you register must belong to you.
• Any account that you give or sell to someone else will be closed.
• If you believe someone has gained access to your account, notify support promptly.

4. Pro subscription

Pro is the subscription for Phoenix Guardian’s premium features. The following features are unlocked with a subscription:

• GPU tuning: undervolting, memory overclocking, fan curve and Graphics Suite.
• Power & Sleep: Auto Shutdown, electricity rate, sleep detection, Scheduled Wake and instant lock.
• The Smart Replay buffer, that is, saving moments that have already happened.
• The internet section: app blocking, network scan and clearing data usage history.

All other features (monitoring, cleanup, standard recording, gaming profiles, reports, alerts and remote control) do not require a subscription.

The subscription period is counted from the moment of activation, not from the moment of payment, and the subscription remains valid until the end of that period. The subscription does not renew automatically, so no amount will be deducted from your account without your knowledge.

5. Hardware tuning and its risks

Part of what the app does is change your graphics card’s settings: voltage, frequency, power limit and fan speed. We do this in a way that is as safe as possible:

• Values never go beyond the range permitted by the driver and the card’s manufacturer.
• A stability test is run before any setting is finalized.
• Any setting can be reverted to its original state with one click, and is also cleared on restart.

If you do not accept this risk, simply do not use the tuning section. The rest of the app works without it.

6. Devices and device limits

Each account includes one device, and if you need more, you can purchase extra device slots. You can view and remove your devices from your account.

Sharing a subscription among several people, or selling access to others, is grounds for closing the account.

7. Prohibited activities

• Circumventing the subscription lock, reverse engineering, tampering with the app’s files, or distributing a modified version.
• Using the service for illegal activity, or to harm other people’s systems.
• Placing abnormal load on the servers, automated scanning, and anything else that degrades the service for others.
• Bulk extraction of calculator data or website content for commercial use.

8. Intellectual property

The app, its code, the names and logos of TweakFa, Phoenix Guardian and Pro, blog content and calculator data belong to TweakFa. Purchasing a subscription grants a right of use, not a transfer of ownership.

To republish blog content, crediting the source with a link is sufficient. For commercial use of the data, obtain permission in advance.

9. Changes to prices and the service

Prices may change, but a price change does not affect your active subscription; until the end of your period, it remains exactly what you purchased.

Features may also be added, changed or removed. If a feature that forms a significant part of your subscription is removed, we will notify you in advance and provide a remedy for the remaining period.

10. Outages and unavailability

Online services experience outages, whether on our side or on the network’s side. The app is built to keep working without an internet connection, and your active subscription remains valid offline for a period of time, but the online parts (your account, payments, Telegram) will be unavailable during an outage.

We have no obligation to compensate for short outages. If a prolonged outage occurs on our side, we will compensate you for the period during which you did not have the service.

11. Limitation of liability

In any event, our liability is capped at the amount you paid for the relevant subscription period. We accept no liability for indirect losses, loss of data or loss of income.

This clause does not deprive you of your statutory consumer rights.

12. Closing your account

You may delete your account at any time; this is explained in the Privacy policy. We, in turn, will suspend or delete an account if any of the clauses above is breached. In the case of an intentional breach (such as circumventing the lock or selling access), the subscription fee will not be refunded.

13. Governing law

This agreement is governed by the laws of the Islamic Republic of Iran. If a dispute arises, we will first seek to resolve it through support, and if it is not resolved, the competent Iranian authority will hear the matter.

14. Changes to these terms

If this text changes, the new version will be published here with a new date. We will also notify you of significant changes through your account. Continuing to use the services after a change means that you accept the new version.
